Terms of Reference (TOR) for Facilitator
1. Introduction
Shanti Foundation is a nonprofit community-based organization, established in 2016 and operated by sex trafficking survivors and HIV infected women’s transforming their grief and shame into courage and power so that other women and girls like them don't have to go through the circumstances they had to. Shanti Foundation’s vision is a world free of stigma and discrimination where all people living with HIV and AIDS and trafficking survivor women, children and youth will lead a life of quality and productivity with equality and freedom in society.
Shanti Foundation is implementing the ‘Prayatna’ project in partnership with the Tdh Foundation and in collaboration with Kathmandu Metropolitan City. The project aims to combat child exploitation through child and youth-led initiatives, integrated services, and advocacy for gender justice. It also seeks to promote human and labor rights for vulnerable groups specially girls and queer community engaged in the Entertainment and Hospitality Sector while contributing to the development and implementation of policies to improve working conditions in the sector.
2. Scope of Work
The facilitator will conduct a half-day knowledge-sharing workshop on diversity and inclusion, with a special focus on LGBTQIA+ issues, targeting municipality and ward representatives, including Entertainment Sector Committee (ESC) representatives. The workshop aims to enhance understanding, promote inclusive work culture, and address the needs and challenges faced by LGBTQIA+ individuals in the sector.
The specific tasks of the facilitator include:
• Designing a structured workshop session on LGBTQIA+, diversity and inclusion.
• Facilitate in providing key concepts related to LGBTQIA+, current situations, issues, rights and challenges through interactive discussion and activities.
• Sharing best practices for promoting diversity and inclusion in workplace policies and culture.
• Offering recommendations on strengthening inclusive policies at the municipal and ward levels.
• Preparing a brief report on the workshop including outcomes and participant feedback.
3. Deliverables
The facilitator is expected to deliver the following:
• A detailed session plan and presentation materials.
• Facilitation of a one-day (including preparation) interactive workshop
• A post-workshop report summarizing key discussions, recommendations, and participant feedback.
4. Required Qualifications and Experience
The facilitator should have:
• Proven experience in conducting training/workshops on diversity and inclusion, particularly related to LGBTQIA+ rights.
• Strong knowledge of human rights, gender justice, and labor rights including recent updated concepts.
• Experience working with government agencies, NGOs, or community-based organizations.
• Excellent facilitation and communication skills.
• Fluency in Nepali and English.
5. Duration and Location
• The workshop will be conducted on a half day at a location designated by Shanti Foundation within Kathmandu Metropolitan City.
• Preparatory work and report submission should be completed within one week of the workshop.
• The work is expected to commence and take a total of 40 working days.

Term of Reference (TOR) for mapping and review of policy framework and services to prevent informal migration and human-trafficking related issues in the Entertainment and hospitality sector
Mapping and reviewing the policy framework and services for the Entertainment and Hospitality Sector is crucial to addressing various challenges, including informal and unsafe migration which often leads to human trafficking. These issues are not sufficiently covered by current policies, highlighting the need for a comprehensive policy and service analysis to identify gaps and develop more effective solutions. The mapping and review process will be carried out in close collaboration with municipalities, wards, business owners, employers, and workers, particularly focusing on girls and members of Queer community working in the sector. This collaborative effort aims to better understand their specific needs and challenges. The local governments, which now bear responsibility for regulating the sector, will benefit from a clear understanding of their roles and the necessary tools to act effectively. As a result, the review will lead to the development of a handbook that will outline the process and steps for engaging with the institutional mechanisms in place to ensure service seekers can access services easily.
The handbook will include guidelines such as a Code of Conduct for employers and employees, monitoring guidelines for municipalities to enforce the Labour Act, SOPs for documenting businesses operating in the respective wards, and instructions for registering workers in the sector. This mapping and review process not only strengthens the policy and service framework but also contributes to realizing the vision of ensuring decent working conditions in the Entertainment and Hospitality Sector.

The objective of the task is to:
• To conduct a detailed review of existing policies and services in the entertainment and hospitality sector to identify gaps and recommend necessary reforms.
• To develop a comprehensive handbook outlining processes and institutional mechanisms to support easy access to services for those in need.
2. Deliverables:
A detailed report on the mapping and review of existing frameworks and services, along with a recommendations report outlining proposed reforms and new policies.
b) After reviewing and analyzing services, a handbook will be developed to explain the steps and processes for different institutional mechanism in place to help service seekers easily access services. The handbook will include a Code of Conduct for employers and employees in the sector, guidelines for the municipality to monitor and enforce the Labour Act, Standard Operating Procedures for documenting businesses operating in the wards, and instructions on registering workers in the sector.
3. Scope of Work:

• Conduct a comprehensive mapping and review of existing policies, frameworks, and services relevant to the entertainment and hospitality sector.
• Identify gaps and deficiencies in current policies and services to address issues in the sector through consultation with municipality officials, wards, Entertainment Sector business owners and associations, employers’ associations, trade unions, like minded CSOs, survivor led network/forum and workers, with a specific focus on vulnerable groups.
B. Analysis and Recommendations:
• Analyse findings from the mapping exercise to propose necessary reforms and amendments to existing policies.
• Suggest changes to the current policies, and in case of gaps, propose formulation of new policies or amendment in existing policies that focus on the needs and challenges of vulnerable groups, ensuring fairness and ethical practices.
• Analyse service provisions and propose a process to access those services and institutional mechanisms
4. Methodology:
• Desk review of existing policies, conduct stakeholder consultations including municipality officials, wards, Entertainment and Hospitality business owners and associations, employers, trade unions and workers, with a specific focus on vulnerable groups such as girls and the queer community.
• Utilize a participatory approach to ensure the views and concerns of all stakeholders are integrated into the recommendations and handbook development.

6. Budget: The Consultant should submit a proposal with budget breakdown.
7. Qualifications:
• Master's Degree in sociology, law, human rights, gender studies and other relevant subjects.
• Demonstrated experience in policy analysis and development, particularly in sectors related to entertainment, hospitality, and vulnerable populations.
• Expertise in conducting stakeholder consultations and preparing comprehensive reports and handbooks.
• Understanding of local governance structures and regulatory frameworks related to labor and human trafficking issues.
Term of Reference (TOR) to develop a knowledge toolkit for marginalized group, ESC and MRC
1. Scope of Work
Vulnerable populations working in entertainment and hospitality sector particularly girls and the members of Queer community, face significant barriers in accessing essential services and support mechanisms. There is a gap in availability of tailored resources and tools that provide comprehensive, accessible, and practical information on key areas such as employment opportunities, safe migration, protection services, skill development, legal support and so on. Absence of a structured and user-friendly knowledge resource limits their ability to access relevant services and reduces capacity of key stakeholders such as Employment Service Centers (ESC) and Migrant Resource Centers (MRC), to provide effective support.
To address this critical gap, development of a tailored knowledge toolkit is essential. This toolkit will serve as a reliable and practical resource, equipping both marginalized groups working in entertainment and hospitality sector and stakeholders with the necessary information to navigate challenges and access appropriate services. Furthermore, to ensure the effective utilization of the toolkit, targeted training for ESC and MRC staff is crucial. This will enhance their ability to offer tailored and informed support, ultimately contributing to improved working conditions and opportunities for marginalized groups in the sector.

• To develop a user-friendly knowledge toolkit to deliver comprehensive information on employment opportunities and related risks, safe migration, skill development, and legal support for marginalized groups working in the hospitality and entertainment sector, especially girls and members of the Queer community.
• To facilitate training for Employment Service Centre (ESC) and Migrant Resource Centre (MRC) and other relevant stakeholders on the application of the knowledge toolkit.
Deliverables:
• Comprehensive Nepali version of the information and knowledge toolkit
• Training agenda, materials, and report.

6. Qualifications
The consultant should possess the following qualifications:
• Master's Degree in sociology, law, human rights, gender studies and other relevant subjects.
• Proven experience in developing specialized toolkits and conducting training sessions in the areas of migration, employment, and social services, with a focus on vulnerable populations including girls and Queer community.
• Familiarity with the legal and social context of Nepal, particularly relating to labor laws and human rights.
• Strong communication and writing skills in English and Nepali facilitation skills with the ability to engage diverse stakeholders effectively.
